Searches & Registrability
We conduct availability and similarity searches and advise on registrability in Türkiye. Our assessments consider relevant earlier rights, potential objections and the goods and services covered by the proposed application.
Filing & Registration
We prepare and file national trademark applications before the Turkish Patent and Trademark Office and handle the proceedings through registration. Classification, filing requirements and supporting documents are reviewed with the instructing firm.
Madrid Protocol
We handle Turkish procedures relating to international registrations under the Madrid Protocol, including provisional refusals issued by the Turkish Patent and Trademark Office. We assess the grounds and prepare responses and supporting submissions.
Trademark Prosecution
We review examination findings and official communications and prepare the necessary responses. Substantive issues, proposed amendments and further action are discussed with the instructing firm before submission.
Oppositions & Replies
We file oppositions against third-party applications and prepare replies to oppositions directed against clients’ applications. Our work includes assessment of the grounds, evidence and arguments throughout the opposition proceedings.
Appeals
We assess and prepare appeals against decisions of the Turkish Patent and Trademark Office. The proposed grounds, supporting evidence and submissions are agreed with the instructing firm.
Trademark Watching
We monitor published applications for marks that may conflict with identified rights. Relevant findings are reported for consideration of opposition or other appropriate action.
Use & Evidence
We review and organise evidence of trademark use for prosecution, opposition and cancellation proceedings. Supporting materials and submissions are prepared according to the requirements of the matter.
Infringement & C&D Letters
We assess suspected infringement and cooperate with specialist legal counsel on cease-and-desist letters, responses and pre-litigation correspondence. Proposed action is discussed with the instructing firm before contact with the other party.
Invalidity & Cancellation
We assist with invalidity and cancellation proceedings, including bringing and defending non-use challenges. Office proceedings and court actions are handled under clearly defined arrangements, with specialist legal counsel involved where required.
Non-Infringement Actions
We work with specialist legal counsel on assessments and court actions seeking a declaration of non-infringement. The factual basis, relevant rights and proposed course of action are reviewed with the instructing firm.
Trademark Litigation
We cooperate with a specialist law firm on infringement, invalidity, non-infringement and related disputes. Court representation is undertaken by appropriately authorised legal professionals.
Enforcement & Customs
We coordinate support concerning counterfeit goods, customs protection and other enforcement measures with specialist legal counsel. The available action, evidence and responsibilities are established for each matter.
Renewals
We monitor and handle Turkish trademark renewals under agreed instruction and reporting arrangements. Records and upcoming deadlines are reviewed when a portfolio is transferred.
Transfers & Recordals
We handle transfers of ownership, name and address changes, licence recordals and merger-related updates. Supporting documents are reviewed and the required submissions prepared for the relevant records.
Agreements
We work with legal counsel on assignment, licensing, coexistence and settlement agreements. The contractual scope and any associated recordal procedures are defined separately.
Due Diligence
We review trademark ownership, registration status, recorded transactions and identified disputes in connection with acquisitions, mergers, investment and other commercial transactions.
Portfolio Management
We coordinate filing, prosecution, opposition, renewal and post-registration work across trademark portfolios. Reviews can identify gaps in protection, record inconsistencies and matters requiring further instructions.
International Coordination
We coordinate trademark work in other jurisdictions through independent local colleagues. The countries, scope, reporting and billing arrangements are confirmed before work begins.
