Searches & Assessment
We conduct design searches and assess relevant earlier disclosures and registrations. Our findings support the instructing firm’s evaluation of novelty, individual character and potential conflicts.
Filing Strategy
We advise on filing routes, the scope of applications and the treatment of product variations. Priority claims, disclosure history and related rights are considered according to the objectives of the engagement.
Drawings & Representations
We review drawings, photographs and other representations for consistency and suitability for filing. Where preparation or revision is required, we coordinate with the instructing firm and relevant specialists.
Filing & Registration
We prepare and file national design applications before the Turkish Patent and Trademark Office and handle the proceedings through registration. Filing documents, product indications and priority information are reviewed before submission.
Hague System
We handle Turkish procedures relating to international design registrations under the Hague System. Our work includes reviewing provisional refusals and preparing responses and supporting submissions.
Design Prosecution
We review official communications and prepare responses concerning application requirements and examination findings. Proposed amendments and substantive issues are referred to the instructing firm for approval.
Oppositions & Replies
We prepare oppositions against third-party design registrations and replies to oppositions directed against clients’ registrations. The work includes assessment of earlier disclosures, supporting evidence and arguments.
Appeals
We assess and prepare appeals against decisions of the Turkish Patent and Trademark Office. The grounds, evidence and proposed submissions are discussed with the instructing firm.
Design Watching
We monitor published design registrations within an agreed scope. Relevant findings are reported for consideration of opposition or other appropriate action.
Validity & Infringement
We assess the validity and scope of design rights and compare them with relevant products or earlier designs. Specialist legal input is coordinated where required for an opinion or proposed action.
Unregistered Designs
We assist with assessing potential protection and enforcement of unregistered designs in Türkiye. Disclosure history, ownership and evidence of copying are reviewed with specialist legal counsel where appropriate.
C&D Letters
We cooperate with legal counsel on cease-and-desist letters, responses and pre-litigation correspondence concerning design rights. Proposed action is agreed with the instructing firm before contact with the other party.
Invalidity Actions
We support challenges to design registrations and defence against invalidity claims. Research into prior designs and documentary analysis are coordinated with the legal professionals responsible for court proceedings.
Non-Infringement Actions
We work with specialist legal counsel on assessments and actions seeking a declaration of non-infringement. The relevant designs, products and factual basis are reviewed before proceedings are considered.
Design Litigation
We cooperate with a specialist law firm on design infringement, invalidity and related disputes. Court representation is undertaken by appropriately authorised legal professionals, supported by relevant design and technical analysis.
Enforcement & Customs
We coordinate support concerning suspected infringement, counterfeit products and customs protection with specialist legal counsel. Available measures and supporting evidence are assessed for each matter.
Renewals
We monitor and handle Turkish design renewals under agreed instruction and reporting arrangements. Registration records and upcoming deadlines are reviewed when responsibility is transferred.
Transfers & Recordals
We handle changes of ownership, name and address, together with assignment, licence and merger-related recordals. Supporting documents and procedural requirements are reviewed for each instruction.
Agreements
We work with legal counsel on design assignment, licensing, coexistence and settlement agreements. Contractual work and associated recordal procedures are separately defined.
Due Diligence
We review design ownership, registration status, recorded transactions and identified disputes for acquisitions, mergers, investment and other commercial transactions.
Portfolio Management
We coordinate applications, prosecution, oppositions, renewals and recordals across design portfolios. Reviews can identify gaps in coverage, inconsistent records and matters requiring further instructions.
International Coordination
We coordinate design work in other jurisdictions through independent local colleagues. Filing routes, local requirements, responsibilities and fees are confirmed before work begins.
